Conditions of purchase
These terms and conditions of purchase and sale of Relaxationland OÜ, registry code 16342122 (hereinafter referred to as Relaxationland) (hereinafter referred to as the Terms and Conditions) apply to all persons (hereinafter referred to as the Buyer) who purchase goods or order services through the Relaxationland e-store (hereinafter referred to as the e-shop).
Relaxationland reserves the right to change or supplement the terms and conditions and the price list without prior notice. These changes and additions will be announced on the website www.relaxationland.ee and will take effect from the moment of publication.
All personal data of the Buyer that has become known during the visit to the Relaxationland e-store and the performance of purchases are confidential. By entering data in the e-shop, the Buyer grants the right to collect and process the Buyer’s personal data (company name, name, contact telephone number, delivery and / or registration address, e-mail address, etc.) and forward the Buyer’s personal data to the person delivering the goods for delivery. The encrypted data communication channel with the banks ensures the security of the Buyer’s personal data and bank details, Relaxationland does not have access to them.
Relaxationland has the right to use the Buyer’s delivery and / or registration address to send advertising and other information about its products and services.
In addition to these terms and conditions, the legal relations arising from the purchase of products from the e-store are regulated by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation in force in the Republic of Estonia.
E-shop ordering process
The buyer adds the desired products to the shopping cart.
To place an order, the buyer presses the “Place order” button on the product page or the information button that displays the contents of the shopping cart.
The buyer checks the products and quantities added to the shopping cart. If the content of the shopping cart is correct, the Buyer clicks on the “Place order” button.
The buyer makes a choice between the two types of e-shop users. Creating an e-store account is not mandatory, e-store orders can be submitted both registered and unregistered. Submitting orders to the e-store when registered and logged in may provide discounts and / or agreed prices for business customers, depending on the campaigns.
The Buyer fills in the columns of contact information and / or delivery data carefully, because the accuracy and correctness of the provided information depends on the fast and smooth delivery of the goods ordered by the Buyer and the subsequent settlement of claims.
The buyer makes a choice as to the method of delivery of the goods. Relaxationland offers the following delivery options:
- The buyer picks up the goods himself at the e-store office in Tartu;
- The goods are delivered to the desired address by courier;
- The buyer orders the goods from a SmartPOST, Omniva or DpD parcel machine.
The buyer chooses the method of payment for the goods. The Relaxationland offers the following options for paying for the goods:
- directly via Internet bank links (Swedbank, SEB, Nordea banks and Mastercard and Visa credit cards);
Orders paid in advance by the Buyer in the e-shop will be processed from the moment of receipt on working days from 08:00 to 17:00. Depending on the volume, orders confirmed after 15:00 may be processed the next business day. Also applies to the “I’ll pick it up” delivery option.
Withdrawal from the contract of sale and return of goods
Relaxationland has the right to withdraw from the sales contract concluded via the e-store without sanctions and not to provide the service or to deliver the ordered goods in the following cases:
- Out of stock
- The price or features of the goods have been incorrectly displayed in the e-shop due to an e-shop system error.
If it is not possible for Relaxationland to fulfill the order submitted in the e-shop, the Buyer will be notified via the contact telephone or e-mail address provided when making the order within 2 working days. The advance payment paid by the Buyer will be refunded within 3 working days, unless otherwise agreed with the Buyer.
In case of non-conformity or defect of the goods, the Buyer has the right to demand that Relaxationland replace the goods with compliant and / or defective goods or withdraw from the sales contract and return the non-compliant goods at Relaxationland’s expense. Purchased goods cannot be returned if they have been manufactured taking into account the personal needs of the Buyer and in accordance with the conditions provided by the Buyer.
Relaxationland is not responsible for defects in the goods caused by:
- due to improper use and / or maintenance;
- natural physical wear and tear in normal use;
- Due to damage caused intentionally or unintentionally by the Buyer;
- maintenance or repairs performed by an unauthorized person.
In the case of consumer retail, the relevant provisions of the Law of Obligations Act apply to the withdrawal from the sales contract and the return of a non-compliant product. Among other things, the Buyer has the right to inspect the goods within 14 days and withdraw from the sales contract within 14 days of delivery of the goods.
In case of withdrawal from the sales contract, the application must be sent to Relaxationland’s e-mail address firstname.lastname@example.org within 14 days. The application must contain information about the returned goods, the reason for the return, the order number and the current account to which the money must be returned.
The returned goods must be complete (include all items in the product packaging) and must not be damaged or used. If the goods have been purchased as part of a campaign where another product has been added to the purchased product, the Buyer must return all products (ie the entire set received).
In the event of withdrawal from the sales contract, the Buyer has the right to bear the transport costs of the returned goods and deduct it from the returned amount. The amount paid for the goods (excluding the cost of delivery of the goods) will be returned to the Buyer’s current account no later than 30 days after receipt of the notice of withdrawal, provided that the returned goods have reached Relaxationland.
In case of return of non-compliant goods, the amount paid for the goods together with the return transport cost will be transferred to the bank account provided by the Buyer no later than 30 days from the receipt of the withdrawal notice, provided the returned goods have reached Relaxationland.
If, after the return of the goods, the inspection of the condition of the goods carried out by Relaxationland has revealed that the goods to be returned have been used or have deteriorated, the Buyer shall be compensated for the decrease in the value of the thing. The Relaxationland may submit a request to this effect within 30 days of the return of the product, and the Buyer is obliged to compensate for the decrease in the value of the product.
If the Buyer does not agree with the decrease in value indicated in the set-off notice, the Buyer has the right to involve an independent expert to determine the decrease in value of the product. The costs related to the expertise shall be divided in half between the Buyer and Relaxationland, unless the position of one of the parties proves to be unfounded. In such a case, the costs of the expert examination shall be borne by the party whose position was manifestly unfounded.
If the goods have been additionally guaranteed by the seller or the manufacturer, the respective conditions shall be set out in writing in the e-shop with the product and shall be applied in accordance with the conditions.
Relaxationland shall be liable to the Buyer and the Buyer shall be liable to Relaxationland for the damage caused to the other party by the violation of these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
Relaxationland shall not be liable for damages caused to the Buyer or for delay in delivery of the product if the damage or delay in delivery of the product is due to a circumstance beyond Relaxationland’s control (incl. Delay in delivery of the goods due to a third party) to see.
Disputes arising between Relaxationland and the Buyer when purchasing products from the e-store will be resolved through negotiations. If the agreement is not reached, the Buyer has the right to apply to the Harju County Court for protection of his rights or submit a complaint to the Consumer Complaints Commission through the Consumer Protection Board. Contacting the Commission is free of charge for the consumer and the value of the transaction must be more than 20 euros. The consumer may lodge a complaint himself or through a representative. The data of the Consumer Protection Commission is available on the website of the Consumer Protection Board.
